Reservation Agreement Terms and Policies:

To make a reservation, you MUST use a major credit card. We do not accept cash or checks.

By accepting services from Midwest Black Car Service, LLC, you understand and agree to all terms and policies listed below and confirm that all the information included in your reservation is correct.

No reservations are confirmed until the NONREFUNDABLE deposit clears. Once a reservation is made, you are committed to that vehicle and for the agreed upon duration of the trip. Vehicle upgrades may be available but cannot be guaranteed. Downgrades are not permitted.

For reservations in other states and internationally, pricing will vary from Indiana rates. Pricing adjustments will be made for all domestic and international reservations.

By voluntarily accepting chartered transportation, You, the “Client”, authorize Midwest Black Car Service LLC to bill the credit card on file for all charges incurred because of services rendered.

NO RIDES OR SERVICES WILL BE PROVIDED WITHOUT PRE-PAYMENT.

(Exceptions may be made for established corporate accounts.)

You have provided this credit card on file for a non-refundable deposit, and as a guarantee for payment for all related charges.

At the discretion of Midwest Black Car Service LLC, all reservations are 100% pre-paid.

These terms apply to everyone in the vehicle, and you are willing to accept complete responsibility for all passengers and associated parties.

If your reservation should be cancelled within 48 hours of the pick-up time, a fee of 50% of the total bill or $100 (whichever is greater) will be charged to the card. You understand that this is a non-refundable deposit.

If you cancel within 24 hours of the pick-up time, you understand that your card will be charged 100% of the total bill. All sales are final and not subject to a refund. Non-refundable deposits are non-transferrable.

If your trip lasts longer than the scheduled time, your credit card will be billed for the extra time.

You are responsible for any damage caused to the vehicle by yourself or the negligence or actions of your agents, employees, or guests, the cost of which will be billed to the credit card on file.

You understand that Midwest Black Car Service LLC provides a service, and you agree that all items that belong to the service provider will remain inside the vehicle in its original condition.

You understand that you are not to decorate, attach, or attempt to modify the appearance of the vehicle, inside or outside. Confetti, glitter, feather boas, or other similar items that cause unnecessary mess will be charged a $100 cleaning fee.

In the event of anyone inside the vehicle becoming sick or causing excessive spillage, or uncleanliness, a minimum cleaning fee of $300 will be charged to the credit card on file.

All vehicles are non-smoking (this includes all “vape devices”.) Any smoking or use of vape devices in the vehicle will result in a minimum fee of $500 to the credit card on file.

Indiana law prohibits minors from consuming alcohol; therefore, you understand and agree that any persons under 21 years of age are not to consume any alcohol while using services provided by Midwest Black Car Service LLC. This includes consumption both inside and outside the vehicle.

Proper identification is always required for all passengers.

Midwest Black Car Service LLC is not responsible for items left in the vehicle, whether lost or stolen, at any time during or after charter.

The driver has the right to terminate the service without refund if the driver or vehicle are subjected to dangerous or unsafe conditions caused by client, its agents, employees, or guests, or if the driver feels conduct of Client or associating parties is unsuitable.

At the driver’s sole discretion, passenger(s) may be removed from the vehicle or reservation if necessary.

You are responsible for not allowing anyone within your rental party, associates, or yourself to carry or use illegal substances while obtaining service from Midwest Black Car Service LLC. No illegal drugs are allowed. If such substances are found during or after the provided service, you are willing to relieve Midwest Black Car Service LLC, the chauffeur, and its owner(s) of all responsibility.

No firearms or weapons are allowed inside the vehicle. You will not allow Midwest Black Car Service LLC or its owners to be liable for any unlawful act that your party or you might engage in.

You understand that to the proportionate extent caused or contributed to by the direct fault or negligence, or by act or omission of either Midwest Black Car Service LLC its subcontractors, agents, or employees in the performance of this contract, each party shall defend, indemnify and hold harmless Midwest Black Car Service LLC, its parents, subsidiaries and affiliates and their owners, officers, directors, employees, agents, and invitees, from all liabilities, damages, losses, claims, suits, judgments, costs and expenses (including reasonable attorneys’ fees), directly incurred from any claim arising out of or in connection with any negligent or intentional acts or omissions by such party, its employees or agents in connection with the event covered by this agreement.

All other indemnification provisions in the agreements are deleted and without effect. As a condition to each party’s duties under this section, the other party must promptly notify such party of any claim for which defense or indemnity is sought, must allow such party to select counsel, and control the claim and litigation, and must cooperate with such party.

You understand that no damages will be due for a failure of performance by either party due to “an act of God”, war, terrorist act, government regulation, riot, disaster, or strike, provided said act or event makes performance hereunder impossible.

Midwest Black Car Service LLC is not responsible for delays or trip terminations due to weather, traffic, construction or road detours, unsafe road conditions, mechanical failure, or any circumstance beyond our control. Refunds are not issued because of tardiness or any other matter. All Sales Are Final.

Clients may request the chauffeur to assist in taking photographs or videos while on charter, however there are not any cameras or video cameras in the back of the partitioned area. You authorize and transfer copyright to Midwest Black Car Service LLC of these images or film to be used in print or electronically. These images may contain all surroundings, your person, or anyone in the rental party for lawful purpose, such as publicity, illustration, social media, advertising, and web content.

You understand that all tolls, parking, and other fees are the responsibility of the chartering group; and are not included in the fare or fees quoted above, unless noted as such.

You understand that if the time surpasses the original reserved time listed above you are responsible for any and all related charges. You also understand that the schedule may not allow for overages, resulting in your transported party being left at a destination at the end of reserved duration. Midwest Black Car Service LLC will do its best to accommodate overage requests and return all passengers to the destination listed above, however, once beyond the contracted agreement, additional time is not guaranteed. Any additional time will be billed to the credit card on file.

**Point to Point, One Way Transfer Service, To Airport, From Airport, To FBO, From FBO is just that. A one-way nonstop transfer. This ONLY applies if your service type above is listed as such service. This does not apply to hourly charters where the chauffeur is dedicated to your group for an allowed amount of time. The vehicle arrives at a pre-arranged time, loads within 15 minutes, and provides one-way nonstop transportation. If the schedule allows for the vehicle and chauffeur to wait more than 15 minutes, additional charges will be incurred. There are no additional stops or drops. One pick-up location and one destination. Roundtrip service will offer the exact same for a reverse trip; must be pre-arranged and approved by management.

Midwest Black Car Service LLC reserves the right to substitute the scheduled vehicle or the color of the vehicle at its own discretion.

Seat Belts: Midwest Black Car Service LLC is subject to the current “Indiana Seat Belt Laws”. All passengers transported by this carrier should be sure to “buckle up”. If passenger/passengers does/do not “buckle up”, Midwest Black Car Service LLC is not responsible for any fines or injury/injuries caused by the passenger’s failure to comply with the law.

If Midwest Black Car Service LLC receives a fine/fines for passenger or passengers lack of complying with the seat belt laws, the cost of the fine/fines will be billed to the party or parties responsible for the rental, to the credit card on file.

Indianapolis International Airport pickup location for Midwest Black Car Service LLC is at Ground Transportation Center, located on the first floor of the parking garage. (As a courtesy to our passengers, the driver will meet your person or group at the bottom of the escalators in the baggage claim area, at no additional cost.)

You hereby state that you have read this information and all statements. You agree that the above rental information is accurate. The nonrefundable deposit placed on your credit card confirms that you voluntarily agree to enter this Rental Agreement with Midwest Black Car Service LLC and allow them to provide services for Client, agents, employees, and guests, for which you are taking complete responsibility for and relieving Midwest Black Car Service LLC of.

You confirm that you are authorized to incur debt on behalf of this credit card account and fully accept the charges associated with services from Midwest Black Car Service LLC.

You confirm that you can contract on behalf of Client(s), to bind Client to the contract and to fully accept the charges associated with services from Midwest Black Car Service LLC.

You personally guarantee compensation to Midwest Black Car Service LLC for all services rendered, charges and fees incurred. If for any reason services are not paid in full within 24 hours of the reservation, an immediate $50 declined nonpayment fee will be assessed.

After 7 days of non-payment, or if there is an outstanding balance, a 10% late fee will be incurred.

After 14 days, the outstanding balance and ongoing late fees will be turned over to collections for remittance. You will then be responsible for all fees, including, but not limited to services rendered, late fees, damages, gratuities, any legal fees, court costs, legal counsel and interest incurred.

Please remember that there is no discount on great service, so please tip on the total bill.
